  • Mr. Padova is an associate with the firm Barth, Berus & Calderon, LLP.
  • Mr. Padova concentrates his practice in the areas of labor & employment, general business and complex litigation matters. 
  • He has extensive experience in wage and hour law, wrongful termination, discrimination, harassment, and retaliation claims as well as both first and third party insurance litigation, complex commercial matters such as trade secret and unfair competition, class actions, contract disputes, catastrophic personal injury and wrongful death cases. 
  • Mr. Padova represents his clients in both State and Federal courts as well as before the Employment Development Department, the Equal Employment Opportunities Commission, the Department of Industrial Relations and Cal OSHA.
  • Mr. Padova assists his clients in minimizing the potential for labor and employment related disputes by performing comprehensive periodic review and analysis of employment applications, offer letters, employment contracts, company handbooks and employee policy manuals, as well as disciplinary and discharge procedures and mandotary binding arbitration provisions.
  • Mr. Padova has been involved in numerous business formations including corporations, partnerships and limited liability companies.  Transactional matters include the drafting, review and analysis of private placement memoranda, operating agreements, buy-sell agreements, equipment acquisitions, commercial leasing, confidentiality agreements, and executive compensation packages.

 Significant Cases

  • Ballardo, et al. v. City of National City (2007): United States District Court; Southern District of California - Significant wage and hour litigation filed on behalf of K9 handlers for the National City Police Department seeking compliance with the Fair Labor Standards Act's overtime provisions.

  • Lockart v. Deere & Company, et al. (2006): Los Angeles County Superior Court; Central District - Products liability matter involving the explosive seperation of a multi-piece wheel on the MLULL 10K extended boom heavy forklift manufactured for the United States Marine Corps.

  • Taylor v. Quantile Wealth Management (2005): Judicial Arbitration and Mediation Service; An employment matter representing the defendant in a case involving claims of Racial Harassment, Retaliation, Breach of Contract, Emotional Distress, and punitive damages.

        Successful Trials

  • Banuelos v. Naturel, LLC, et al. (2004): San Bernardino County Superior Court; Rancho Cucamonga - Successfully represented the defendants in a Wrongful Termination, Breach of Contract, and Fraudulent Inducement to Hire case.

  • Tesfasilase v. Coronado Apartments, et al. (2003): Los Angeles County Superior Court; Long Beach - Sucessfully represented the plaintiff in a Housing Discrimination, Sexual Harrasment, and Sexual Battery case in an effort to force the owner of multiple apartment buildings to conduct minimal background checks prior to hiring and handing apartment keys to its on-site employees. The defendant hired a registered sex offender.
